Australian Safety Signs will make good by replacement within a reasonable time after notification by the buyer, defects in the products arising from faulty materials or workmanship provided always that the buyer establishes to the satisfaction of Australian Safety Signs that the product was defective at the time of the sale by Australian Safety Signs. This warranty by Australian Safety Signs is in lieu of any other rights that would otherwise be conferred on the buyer under law save that it does not exclude any conditions and warranties implied in the provisions of the Trade Practices Act 1974, or by any other federal or State laws to the extent that such conditions or warranties may not be excluded by express agreement.
Subject to clause (2), and except to the extent that liability cannot legally be limited or excluded, Australian Safety Signs shall not be under liability whether in contract, tort (including negligence) or otherwise, for any injury, loss,damage, expense (including any indirect or consequential loss or damage), loss of contact, profit or revenue, production stoppage or replacement services arising out of or in connection with its products, their use or replacement.
The buyer and or user warrant that they have not relied on any representation made by Australian Safety Signs, its agents or resellers, or upon any descriptions, illustrations or specifications contained in any this website, document including catalogues or publicity material produced by Australian Safety Signs. The buyer and or user shall at all times indemnify and hold harmless Australian Safety Signs, its officers and employees (‘those Indemnified”) from and against all suits, actions, claims,demands, costs and expenses (including legal costs and expenses) incurred or suffered by those indemnified arising out of or in connection with any wilful, unlawful or negligent act or omission of the buyer and or user in relation to the use or placement of Australian Safety Sign products.
